Please read these Terms of Service carefully before using Plantorbia. By accessing or using our service, you agree to be bound by these terms.

1. Acceptance of Terms

By creating an account, accessing, or using the Plantorbia platform (including our website at www.plantorbia.com and our mobile application, collectively the "Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Refund Policy, all of which are incorporated by reference.

If you do not agree to these Terms, you must not access or use the Service. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Description of Service

Plantorbia is a plant care platform that allows users to:

  • Track and manage their plant collection
  • Receive personalised plant care advice via an AI chat assistant
  • Identify plants from photos using AI and third-party identification services
  • Check plant health for signs of disease and pests from photos using AI
  • Set care reminders and track watering, fertilisation, and other events
  • Maintain a plant wishlist and progress photo timeline
  • Access tools such as light assessment and fertiliser calculators

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where possible.

3. Eligibility and Accounts

3.1 Age Requirement

You must be at least 16 years of age to use the Service. By using Plantorbia, you confirm that you meet this requirement. If you are under 18, you confirm that you have obtained consent from a parent or legal guardian.

3.2 Account Registration

You must create an account to access most features of the Service. You agree to provide accurate, current, and complete information and to keep your account information updated. You are responsible for safeguarding your password and for all activity that occurs under your account.

3.3 Account Security

You must notify us immediately at support@plantorbia.com if you suspect any unauthorised use of your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

4. Subscription Plans and Billing

4.1 Plans

Plantorbia offers the following subscription tiers:

  • Free: limited features, no payment required
  • Basic: expanded limits, billed monthly or yearly
  • Pro: higher limits and full plant history retention, billed monthly or yearly
  • Expert: unlimited access and priority support, billed monthly or yearly

4.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. By providing payment information, you authorise us to charge your payment method for the applicable subscription fee. All prices are in US Dollars (USD) unless otherwise stated.

4.3 Automatic Renewal

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period.

4.4 Price Changes

We reserve the right to modify subscription prices. We will provide at least 30 days' notice of any price change via email or in-app notification. Continued use after the effective date of a price change constitutes acceptance of the new price.

5. AI-Generated Content and Disclaimers

5.1 Nature of the Advice

The Service uses artificial intelligence, together with third-party plant identification services, to generate plant care advice, health assessments, and identifications. This content is informational only and does not constitute professional horticultural, agricultural, or medical advice.

5.2 No Guarantee of Accuracy

AI-generated responses may be inaccurate, incomplete, or outdated. Plant identifications and health assessments carry inherent uncertainty. You should verify this advice with a qualified professional before taking action, particularly where plant health, food safety, or significant financial decisions are involved.

5.3 Your Responsibility

You are solely responsible for how you use the information provided by the Service. Plantorbia is not liable for any damage to plants, property, health, or financial loss arising from reliance on this content.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Upload content that is illegal, harmful, defamatory, or obscene
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated tools to scrape, crawl, or harvest data from the Service without our written consent
  • Impersonate any person or entity, or misrepresent your affiliation
  • Introduce malware, viruses, or any other harmful code
  • Circumvent or abuse the tier limits or usage quotas of the Service

We reserve the right to suspend or terminate accounts that violate these provisions without notice or refund.

7. User Content

7.1 Ownership

You retain ownership of all content you upload or create on the Service, including plant photos, notes, and profile information ("User Content").

7.2 Licence to Plantorbia

By uploading User Content, you grant Plantorbia a non-exclusive, royalty-free, worldwide licence to store, process, and display your User Content solely for the purpose of providing the Service to you. We do not sell your content to third parties.

7.3 Your Representations

You represent that you have all necessary rights to upload your User Content and that it does not infringe any third-party intellectual property, privacy, or other rights.

8. Intellectual Property

All software, design, trademarks, logos, and other intellectual property comprising the Service (excluding User Content) are owned by or licensed to Plantorbia. Nothing in these Terms transfers any intellectual property rights to you. You may not reproduce, distribute, or create derivative works from our intellectual property without express written permission.

9. Third-Party Services

The Service integrates with third-party providers for language processing, data infrastructure, and plant identification. These providers operate under their own terms and privacy policies. Plantorbia is not responsible for the practices or content of third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PLANTORBIA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR PLANT LIFE) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PLANTORBIA IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

12. Indemnification

You agree to indemnify, defend, and hold harmless Plantorbia and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

13. Termination

Either party may terminate the relationship governed by these Terms at any time. You may delete your account through the account settings. We may suspend or terminate your account immediately if you breach these Terms or engage in conduct we determine to be harmful to other users or to the Service.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and indemnification) will continue to apply.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with applicable law. Any dispute arising out of or relating to these Terms or the Service shall first be addressed by good-faith negotiation between the parties. If a dispute cannot be resolved informally, it shall be subject to binding arbitration or the jurisdiction of competent courts, as applicable under the laws of the jurisdiction in which Plantorbia operates.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page and updating the "Last updated" date. For significant changes, we will also send an email to registered users. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
